We are FUFU FOODCRAFT registered company number RA0067852-A, a handcrafted and innovative desserts business development at A-12-6 DPC, Jalan PJU 1/42, Dataran Prima, 47301 Petaling Jaya, Selangor (the “Company” or “FUFU FOODCRAFT”).
By ordering any of the Company’s products or engaging the Company’s services, you agree to be bound by the following Terms and Conditions. These Terms and Conditions are the proprietary property of the Company and the Company reserves the right to amend these Terms and Conditions at any time.
Definitions
In these Terms and Conditions:
• “Account”means the FUFU FOODCRAFT Account that you will need to register on the Company’s Platform in order to submit an Order;
• “Business Day”means a day from 10.00 a.m. to 8.00 p.m., excluding Saturdays, Sundays, and gazetted public holidays in Malaysia;
• “Order Confirmation”means an email from the Company acknowledging your Order in accordance with clause 6. below;
• “Contract”means your Order in accordance with these Terms and Conditions as accepted by the Company in accordance with clause 6. below;
• “Customer”means any individual or entity who places an Order on the Platform;
• “Order”means the Order submitted by Customer on the Platform in relation to the purchase of Product from the Company;
• “Platform”means collectively, FUFU FOODCRAFT’s Website, and any other websites or applications which we may own or operate from time to time, each of which shall be described as a “Platform”;
• “Website”means the FUFU FOODCRAFT website as accessible at the following web address- www.fufufoodcraft.com;
• “You”means a Customer or a guest on the Platform;
• References to “clauses”are to clauses of these Terms and Conditions;
• Headings are for ease of reference only and shall not affect the interpretation or construction of these Terms and Conditions;

Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Governing Law
The use of www.Fufufoodcraft.com and these Terms and Conditions shall be governed by and construed in accordance with Malaysian law and you hereby submit to the exclusive jurisdiction of the Malaysian courts.
Order
You may follow the instruction on the ordering page to place your order. It is necessary that you provide the requested information for us to process your order. We reserve the right to request further information from you at any time to enable us to complete your order and/or to comply with regulatory requirements. By placing an order, you confirm that the details contained in the order are correct in all respects. We will use various procedures to authenticate each transaction. Order details cannot be amended after the order has been placed.
A contract between you and us is formed when we receive your confirmation order and send you a confirmation email that your order has been accepted. Please keep a copy of the confirmation page for your records. We may, at any time, decline to process your order or any part of your order for any reason including where insufficient or incorrect information has been provided.
You will be required to choose your payment method at the time of online ordering. Payment is required upon placing an order. Cash on delivery is not accepted. Upon completion of your order, you will receive a confirmation email with an order summary and invoice.
Cancellation
All orders can only be cancelled before they are fulfilled. Upon cancellation of the order, any refund will be credited as store credit to the customer's account at Fufufoodcraft.com to be used on the next purchase. Refunds to the credit card or cash are not available. No refund for cancellation once the order is fulfilled.
Goods
All illustrations and descriptions displayed on www.fufufoodcraft.com website or distributed by email or in any other way are for guidance purposes only and will not form part of the contract. In all cases we will try to contact you to advise you of any such changes, however, Fufu Foodcraft reserves the right to replace these items of equal or better quality without consultation. We reserve the right to make alterations to the design, appearance, and technical specifications of our products from time to time and at such time or at any other times, to make alterations to our advertised information concerning such Goods, without notice.
Allergies and special dietary Requirements
Please note that all of our desserts may contain dairy and eggs. Some of the ingredients used may/could contain traces of nuts and soy products. Fufu Foodcraft will not be held responsible for allergies caused by the consumption of our product.
Storage and Consumption
Our product does not contain any additives or preservatives. It's individual packaging, however, it is strongly recommended that our cake/gelato be kept in the chiller (cake) / freezer (gelato) for longer shelf life (cake up to 3 days / gelato up to a month). As our cake/gelato are fresh and natural ingredients, we are therefore unable to make a warranty as to the cake/gelato will be having the exact same appearance for every batch. It is the responsibility of the customer to keep the cake/gelato in the manner prescribed by us.
Delivery Conditions
Our products are to be delivered to you at the provided address by our own drivers and third-party Logistics Company. We do delivery within Klang Valley only at the moment. It is essential to ensure someone is available to receive the products at the delivery time. Customers are responsible for paying the shipping cost for any second attempt of shipment.
Fufu Foodcraft would not be held liable for any missing or damaged product at the advised destination once the products have been delivered. It is the customers’ responsibility to check that the order is complete in good condition upon delivery. If the product is found damage upon receiving, the customer should not accept the parcel and immediately return to the courier representative. Once the products have been accepted and signed for, Fufu Foodcraft is unable to accept any liability neither for any damage sustained to the products thereafter nor for any failure to follow the instructions provided.
Force Majeure
Fufu Foodcraft shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii)outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any license or consent), (iv) fire, explosion, flood, fog or adverse weather, (v)power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond Fufu Foodcraft reasonable control.
Complaints
We value customers’ experiences and opinions. If you experience any problem or are not entirely satisfied with our products, we are here to help. Any complaints must be made within [24] hours upon receiving the products.
Returns & Refunds Policy
All products sold are NOT RETURN AND REFUNDABLE except for quality defective. If there is quality defective, kindly refer to the PRODUCT DEFECTS section below for new product shipment.
[Product Defects]
1. All parcel will be packed in paper bag / cooler bag / handle bag. If the parcel is not in good condition when you receive, please don't let the “driver” leave.
a. Take a photo of your consignment note and the parcel.
b. Don't accept the parcel, ask the driver to return to us.
c. Send us the photos and we will ship out a new parcel within seven (7) working days.
2. If you accidentally received the parcel and only found the defect products after you open the parcel,
a. Take a photo of the defect product and send to our customer service
b. We will do compensate within seven (7) working days.
3. If you found that the product received isn't same with what you ordered,
a. Take a photo of the defect product and send to our customer service
b. If we are shipping the wrong product to you, you can returned back and we will send out the exact product to you within seven (7) working days.

Shipping
Shipping costs are non-refundable. Customers will be responsible for paying for their own shipping costs for returning their items. If a customer receives a refund, the cost of return shipping will be deducted from the refund.
The maximum refund offered is the value of the product. Further compensation is not available. We ask for patience with factors that may be beyond our control (e.g. traffic conditions etc.) as we cannot be held liable for any such delays.
